1. Scope
These Terms & Conditions apply to contracts between

and our clients for the creation and sale of Dirndlblüte handbags, accessories and related products.
Individual agreements made with a client take precedence over these Terms & Conditions.
Any terms and conditions submitted by a client shall only apply if expressly accepted by us.
2. Dirndlblüte Couture
Dirndlblüte Couture represents our individually commissioned work.
Each Couture piece is created specifically for the individual client following personal consultation and is made according to the client's individual selection and specifications.
Depending on the commission, these may include the choice of leather, colour, materials, dimensions, design details and other individual features.
Each Couture piece is individually crafted and is not a mass-produced product.
The individual specifications agreed with the client will be documented as part of the respective offer or order confirmation.
3. Dirndlblüte Prêt-à-Porter
Dirndlblüte Prêt-à-Porter comprises a curated selection of established Dirndlblüte designs offered either as finished Ready-to-Wear pieces or as Made-to-Order pieces.
Ready-to-Wear
Ready-to-Wear pieces are finished handbags or accessories available for immediate purchase, for example at selected pop-up events or other in-person sales locations.
Made-to-Order
Selected Prêt-à-Porter designs may also be individually made to order.
For a Made-to-Order piece, the client selects an existing Dirndlblüte design and chooses from the curated selection of leathers, colours and other options offered for that particular design.
The piece is then individually crafted following the client's order and selected specifications.
Unlike Dirndlblüte Couture, Made-to-Order Prêt-à-Porter is based on an established Dirndlblüte design and a curated range of available options rather than the development of an individually commissioned Couture design.
4. Website and Enquiries
The website www.dirndlbluete.de serves to present Dirndlblüte, our collections, craftsmanship and atelier.
Products cannot currently be purchased directly through the website.
Clients may contact us by email or telephone or arrange a private appointment to discuss a Couture or Made-to-Order commission.
An enquiry, consultation or appointment does not in itself constitute a binding order.
5. Orders and Conclusion of Contract
Following consultation, we may provide the client with an individual offer or order confirmation setting out the relevant design, specifications, price and, where applicable, the estimated production and delivery time.
A contract is concluded when we expressly accept the client's order, in particular by sending a written order confirmation, or otherwise expressly confirm that we will carry out the commission.
The specifications stated in the individual order confirmation form part of the contract.
The client is responsible for checking the agreed model, leather, colour and other specifications stated in the order confirmation and for informing us promptly of any discrepancy before production begins.
For Ready-to-Wear pieces purchased in person, the contract is generally concluded upon agreement on the purchase and payment of the purchase price.
6. Prices and Payment
All prices quoted to consumers are in euros and include statutory German VAT where applicable, unless expressly stated otherwise.
For Couture and Made-to-Order commissions, the applicable price and payment terms will be communicated before the order becomes binding.
Dirndlblüte may require a deposit or advance payment before production begins. Any applicable deposit, payment schedule and shipping or delivery costs will be specified in the individual offer or order confirmation.
7. Production and Delivery
Couture and Made-to-Order Prêt-à-Porter pieces are individually crafted following the client's commission. Production therefore requires an appropriate amount of time.
The anticipated production or delivery period will be communicated as part of the individual offer or order confirmation.
Unless expressly agreed as a binding deadline, stated production and delivery times are estimates.
Should circumstances arise that materially affect the anticipated completion or delivery time, we will inform the client as soon as reasonably possible.
8. Returns, Exchanges and Right of Withdrawal
Couture
Dirndlblüte Couture pieces are individually commissioned and produced according to the client's individual selection and specifications.
Where a piece is not prefabricated and the client's individual choice or specification is decisive for its production, or where the piece is clearly tailored to the client's personal requirements, the statutory right of withdrawal does not apply pursuant to Section 312g(2)(1) of the German Civil Code (Bürgerliches Gesetzbuch – BGB).
Accordingly, individually commissioned Couture pieces meeting these statutory requirements cannot be returned or exchanged due to a change of mind.
Made-to-Order Prêt-à-Porter
Made-to-Order Prêt-à-Porter pieces are produced following the client's individual order. The client selects the design and chooses from the leathers, colours and other options offered by Dirndlblüte for that design, and the selected piece is then individually produced for the client.
Where the client's individual selection is decisive for the production of the piece and the statutory requirements of Section 312g(2)(1) BGB are met, the statutory right of withdrawal does not apply.
Such individually produced Made-to-Order pieces cannot be returned or exchanged due to a change of mind.
Ready-to-Wear Prêt-à-Porter
For finished Ready-to-Wear Prêt-à-Porter pieces purchased in person, including at pop-up events, Dirndlblüte does not offer a voluntary right of return or exchange, unless expressly agreed otherwise at the time of purchase.
Any mandatory statutory rights applicable to the individual transaction remain unaffected.
Defective Goods
The exclusions above do not affect the client's statutory rights in the event of defects or where a product does not conform to the contractually agreed specifications.
9. Leather, Colour and Natural Characteristics
Dirndlblüte works with carefully selected materials, including natural leather.
Leather is a natural material. Variations in grain, texture, structure and colour are inherent characteristics of the material and contribute to the individuality of each piece.
Such natural characteristics do not in themselves constitute a defect, provided that the piece corresponds to the quality and specifications agreed with the client.
Colours displayed digitally may differ from the actual material due to differences in screens, device settings and lighting conditions.
For Couture and Made-to-Order commissions where precise colour selection is important, we recommend reviewing the relevant physical leather or material sample before confirming the order.
10. Craftsmanship
Dirndlblüte pieces are individually crafted by hand.
Minor variations resulting from genuine artisanal production are characteristic of handcrafted work and do not constitute defects where they do not impair the agreed quality, functionality or intended use of the product.
11. Care
Leather and other fine materials require appropriate care.
Clients should follow the care instructions supplied with the product or otherwise provided by Dirndlblüte.
Damage caused by improper use, inappropriate storage, unsuitable cleaning or care products, excessive exposure to moisture, heat or other external influences does not constitute a product defect where the damage results from such treatment.
Normal wear and tear resulting from ordinary use is likewise not a defect.
12. Statutory Rights in the Event of Defects
The client's statutory rights in respect of defects apply in accordance with German law.
Nothing in these Terms & Conditions excludes or limits mandatory statutory consumer rights relating to defective goods.

13. Liability
We are liable without limitation for damage caused intentionally or by gross negligence.
We are also liable without limitation for damage resulting from injury to life, body or health where such damage is caused by an intentional or negligent breach of duty by us or by our legal representatives or agents.
In the event of a negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical of the contract, except in cases involving injury to life, body or health.
A material contractual obligation is an obligation whose performance is essential to the proper execution of the contract and on whose performance the client may normally rely.
Mandatory statutory liability, including liability under applicable product liability law, remains unaffected.
14. Retention of Title
Products remain the property of Dirndlblüte until the agreed purchase price has been paid in full.
15. Data Protection
Information about the processing of personal data can be found in our Privacy Policy available on this website.
16. Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer conciliation body (Verbraucherschlichtungsstelle).
17. Applicable Law
German law applies to contracts concluded with Dirndlblüte.
Where the client is a consumer and has their habitual residence in another country, this choice of law does not deprive the client of mandatory consumer protection afforded by the law of the country in which they have their habitual residence.
18. Final Provisions
If any provision of these Terms & Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
Mandatory statutory provisions remain unaffected.
